1. Use of the Trains4U.com Site
The Trains4U.com Site is provided to you free of charge for your personal use subject to these Terms and Conditions and our Privacy Policy. By using the Trains4U.com Site you agree to be bound by these Terms and Conditions and our Privacy Policy.

Trains4U.com reserves the right to refuse to post material on the Trains4U.com site or to remove material already posted on the Trains4U.com site.
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out of or in connection with:
• any claim by any third party that the use of the Trains4U.com site by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;

9.  Availability of the Trains4U.com site
Although Trains4U.com aims to offer you the best service possible, Trains4U Ltd makes no promise that the services at the Trains4U.com site will meet your requirements. Trains4u Ltd cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it us as soon as possible and we will attempt to correct the fault as soon as we reasonably can.
Your access to the Trains4U.com site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Trains4U Ltd will attempt to restore the service as soon as it reasonably can.

10.  Trains4U Ltd's right to suspend or cancel your registration
Trains4U Ltd may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the Trains4U.com site.
The suspension or cancellation of your registration and your right to use the Trains4U.com site shall not affect either party's rights or liabilities.
Paragraphs 6, 7 and 11, The Returns Policy and Privacy Policy of these Terms and Conditions shall survive cancellation.

11.  Trains4U Ltd's liability
The Trains4U.com site is provided by Trains4U Ltd without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
The Trains4U.com site provides content from other Internet sites or resources and while Trains4U Ltd tries to ensure that material included on the Trains4U.com site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Trains4U Ltd will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Trains4U.com site. If Trains4U Ltd. is informed of any inaccuracies in the material on the site we will attempt to correct the inaccuracies as soon as we reasonably can.
In particular, we disclaim all liabilities in connection with the following:

• Incompatibility of the Trains4u.com Site with any of your equipment, software or telecommunications links
• Technical problems including errors or interruptions of the Trains4U.com site
• Unsuitability, unreliability or inaccuracy of the Trains4U.com site
• Inadequacy of the Trains4u.com site to meet your requirements 

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Trains4U.com site.
Nothing in this paragraph applies to Trains4U Ltd’s liability in respect of products sold through the online store.
Nothing in these Terms and Conditions shall exclude Trains4U Ltd's liability for personal injury or death caused by it's negligence.

If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

If you breach these Terms and Conditions and Trains4U Ltd ignores this, Trains4U Ltd will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
Trains4u Ltd shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

Conditions of Sale

1. Descriptions, Prices And Product Information
 We have taken care to describe and show products as accurately as possible. Despite this, slight variations in products may occur. If there is anything which you do not understand, or if you wish to obtain further information, please contact us via our contact page or call on 01733 895989. Calls will be charged at your standard network rate.

Every effort is made to ensure that prices and information shown for products are correct at the time the product is added onto the Trains4U.com Site.

The price offered in respect of a product on the Trains4U.com site may differ from the price offered at the same time in the Trains4U showroom or on third party auction websites. We are under no obligation to honour prices or promotions shown elsewhere in the event that it differs from those on the Trains4U.com site, or vice-versa.

If, by mistake, we have under priced a product, we will not be liable to supply that product to you at the stated price, provided that we notify you before we despatch the product to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the product at that price. If you decide not to order the product, we will give you a full refund on any amount already paid for that product in accordance with our refund policy below.

All prices are expressed inclusive of any applicable VAT payable unless otherwise stated.

2.   Availability
We try to ensure that we always stock the full product range. If a product is out of stock it will not be possible to order the item from our site.

If for any reason beyond our reasonable control we are unable to supply a particular product, we will not be liable to you except to ensure that you are not charged for that product, or any monies already taken are refunded at the earliest possible opportunity.

Some products are only available to purchasers above a certain age, as shown on the relevant product page. You confirm that, by placing an order for a product which is only available to purchasers above a certain age, you are of the required age. If you are buying a product for someone else, please make sure that the person who you are buying it for is also of the required age.

3. Your Order
Your order is an offer to buy from us. After you have placed your order we will send you an email confirming your order. If you would like to cancel your order at this stage you are free to do so in accordance with our cancellation policy in section 5 below.

Nothing that we do or say will amount to any acceptance of your offer until immediately before we despatch a product to you, at which point a contract will be made between us. At any point up until then we may decline to supply a product to you. If we decline to supply a product to you and you have already paid for it, we will give you a full refund of any amount already paid for that product in accordance with our refund policy in section 6 below.

Where products are despatched separately, our acceptance of the order in respect of each product takes place immediately before that product is despatched. 

4. Delivery
Ownership of the product will pass to you immediately before we despatch the product.

Delivery will be made to the address specified when you complete the order.

Please note, we will only deliver to the following countries:

New Zealand

VAT is deducted on all items shipped outside the EU

If we are shipping outside the United Kingdom, you (or whoever you have asked us to deliver the product to) will be the declarant and importer of the products and you will be responsible for any import duties or taxes.

We use a variety of delivery methods.  We will use the most cost effective means of delivery appropriate for the items ordered, unless a premium service has been specifically selected and paid for.

Whilst we make every effort to deliver all your products within 30 days of the date of your order, we shall not be responsible if we fail to do so in part or in full due to circumstances beyond our control. If we cannot despatch all or part of your order within 30 days, we will automatically cancel the unfulfilled part of your order and send you an email to let you know this.

Sometimes a signature is required at delivery. By placing an order you are authorising us to accept signature from another person on your behalf if you need to sign for a product and you are not present at the time of delivery. If no-one is present at the time of delivery our courier may put a card through your letter box explaining that a delivery was attempted. It is your responsibility to comply with the instructions on the card. If the product is returned due to non-delivery we will give you a refund in accordance with section 6 below. At this stage, if you would still like your product, you will have to place a new order.5. Cancellation of Order
If you would like to cancel your order you can do this by calling us on 01733 895989 during our normal working hours.
If the product has already been dispatched, you must return the product in accordance with our Returns Policy.

6. Refunds
If you are entitled to a refund, we will refund you on the payment card you used for the purchase

The refund of 
postage costs will be determined as per our returns policy.

If an order is cancelled before it is shipped, the entire amount paid, including any delivery charges, will be refunded.7. Payments 
Payments made via Trains4U.com  for all products will be accepted and processed by SagePay on behalf of Trains4U Ltd.

You can pay by Mastercard, Visa (credit or debit), Maestro, or American Express.

Authority for payment must be given at the time of order. If there is a problem with your authorisation or payment we will let you know (this may be via a message on the Trains4U Website, an email or by Trains4U telephoning you).

Products may also be paid for by collecting from our showroom.  If the "Collect in Person" option is chosen, payment must be made at the time of collection by any accepted means, this can inculde, but is not limited to:  Cash, Payment Card, Gift Vouchers and Part Exchange.

Gift Vouchers cannot be redeemed on the Trains4U.com website

8. Free Gifts And Promotional Products
Free gifts and promotional products that are given away in conjunction with a purchase may be despatched to you separately and delivery times may vary.

If you change your mind and return your product under the returns policy you must also return any free gift or promotional product associated with the promotion and received by you as a result of that order in order to receive a refund.

If your order contains any items that are discounted due to the purchase of a different qualifying product, you must return both the discounted item and the qualifying product.
If only the qualifying product is returned, we will refund the cost of the qualifying product, less the discount gained on the discounted item.
9. Our Responsibility to You
If we are in breach of these Product Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order. Our products are for personal use only and our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

Our responsibility to compensate you in connection with any order will not exceed the total price charged for the products.

This section 9 shall not limit or affect our liability resulting from any products sold being found to be unsafe or if something we do negligently causes death or personal injury.

10. General
You may not transfer any of your rights under these Conditions of Sale to any other person. We may transfer our rights under these Conditions of Sale to another business where we reasonably believe your rights will not be affected.

If you breach these Conditions of Sale and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach these Conditions of Sale.

We shall not be responsible for any breach of these Conditions of Sale caused by circumstances beyond our reasonable control.

Except as expressly set out in these Conditions of Sale, all use of your personal information will be made in accordance with our Privacy Policy.

When ordering from the Trains4U.com website we accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology, for example, 3.0 version or higher of Explorer and versions 3.02 or higher of Firefox. This means you cannot inadvertently place an order through an unsecured connection.

Returns Policy

Faulty Items

If any of the goods are faulty please notify us of your intent to return the item(s) using our contact details.
Please describe the nature of the fault in your message.  It may be possible to rectify the problem without you having to return the item(s).

On receipt of the item, we may initially attempt a repair, if a repair cannot be effected we will provide a replacement.
Should a replacement item be unavailable, we will refund the original purchase price.

Trains4U will refund any return postage costs associated with faulty items. Please use the most cost effective return postage method. (Second class recorded is recommended)
If the item(s) returned comprises the entire original order, and we issue a refund, We will also refund the original delivery costs.

If the item is returned to us and is found to be without fault, or is damaged due to accident or mistreatment, it will be returned to you.  Return postage costs will not be refunded.  The item will be subject to a return postage charge.  We will notify you of this in any case.   
If the item is damaged, we will offfer the opprortunity for the model to be repaired.  Repairs will be charged at our normal servicing rates, plus the cost of any parts used.

If the item is recieved as damged in transit, please re-pack the unused item and return it to us immediately.  We will replace the item or refund if a replacement is not available.  Return postage fees wil be refunded.

Any item that you wish to return that is found to be incompatible with your layout, control system, or any other component or system must be treated as an unwanted item.

Unwanted Items

You must notify us of your intent to return any unwanted items within 7 working days of receipt of your order.
Any notification of returns goods must be made in writing.

You must take reasonable care of the products that you wish to return and not use them.  
Where possible return all instructions, labels and the original packaging. 

If the item has been damaged due to accident or mistreatment, it will be returned to you.  Return postage costs will not be refunded.  The item will be subject to a return postage charge.
Return postage costs for unwanted items will be at your own expense.  
Please ensure that you use appropriately insured postage for items with a value greater than the current Royal Mail standard limitation.

Trains4U Ltd will refund the original purchase price of any returned items within 30 days
Trains4U Ltd will not be liable for the refund of the original delivery costs associated with unwanted items.

Please take note of our Refund conditions in respect of unwanted products.

Information collected

Trains4U Ltd collects the details provided by you on registration together with information we learn about you from your use of our service and your visits to our web site and other sites accessible from them. We also collect information about the transactions you undertake including details of payment cards used.
